1. Operator, Subject Matter, Scope

1.1 These terms of use (hereinafter referred to as "Terms of Use") apply to the use of the mediation service operated on the website experievities.gr (hereinafter referred to as the "Platform"), where users can find, compare and see informations about activities offers from providers. The platform is operated by Ioanna Mitroulaki, Kolonnenstr. 8, 10827 Berlin (hereinafter referred to as "we" or "us").

1.2 Definitions:

1.2.1 Contributions, comments, messages, ratings, or other content that users communicate on or through the platform are referred to as "user contributions."

The use of the platform is free of charge.

2. Presentation of Third-Party Providers on the Platform

2.1 The services advertised on the Platform are exclusively services provided by third parties. The offers of the respective third-party providers are linked by us on the Platform. By clicking on the respective links, you will be redirected to the website of the respective provider.

3. Requirements for User Contributions

3.1 Third-Party Rights: Only lawful user contributions (messages, ratings, etc.) may be communicated on or through the Platform. In particular, user contributions and/or their posting on the Platform must not infringe upon the rights of third parties (e.g., rights to a name, trademarks, copyright, data protection, privacy rights, etc.). The user assures us that they have the necessary rights to post their user contributions to the Platform freely and that they do not infringe upon the rights of third parties.

3.2 Other Content Requirements: User contributions, whether in the form of images or text, must not include depictions of violence or be sexually offensive. They must not contain discriminatory, offensive, racist, defamatory, or otherwise illegal or immoral statements or depictions. User contributions must not contain false factual claims or libelous remarks.

3.3 No Linking: User contributions must not contain links to other websites or content.

4. Blocking of User Contributions

4.1 We are entitled to block and/or delete user contributions at any time.

5. Termination

5.1 The user agreement can be terminated by both parties at any time.

6. Making travel bookings via experievities.gr

6.1 When using our Platform (experievities.gr) to make travel bookings, it is important to note that experievities.gr is not a travel agent and does not assume responsibility for the travel options or prices displayed on the experievities.gr Platforms and/or its Services. The travel products you find and book through experievities.gr are provided by independent travel agents, operators, or other third parties known as "Travel Providers.". Our Platform (experievities.gr) acts as a facilitator for your bookings with these Travel Providers but holds no liability towards you regarding such bookings. At the time of booking, you will be informed about the identity of the relevant Travel Provider on Third Party Providers' website and the specific terms and conditions that apply to your booking (referred to as "Travel Provider Terms"). It is crucial for you to carefully read and understand these Travel Provider Terms before finalizing your booking. The Travel Provider Terms outline your rights against the Travel Provider and clarify their liability in case of any issues. By using our Platform (experievities.gr), you agree to fully comply with all applicable Travel Provider Terms. It is important to note that violating these terms may result in ticket or reservation cancellations and additional charges.

7. Restrictions and exceptions to liability

The following applies to our liability for damages:

7.1 In cases of our intent and gross negligence, we are liable according to the statutory provisions. The same applies to damages caused by our negligence resulting in injury to life, body, or health.

7.2 In cases of negligently caused property and financial damages, we are only liable for the breach of a material contractual obligation, but limited in amount to the foreseeable and typical damages at the time of contract conclusion. Material contractual obligations are those obligations whose fulfillment enables the proper execution of the contract and on which the contracting party regularly relies.

7.3 In all other cases, our liability, regardless of its legal basis, is excluded.

7.4 The exclusions and limitations of liability in the preceding paragraphs (1) to (3) also apply accordingly to the benefit of our agents.

7.5 Liability for assuming a guarantee or under the Product Liability Act remains unaffected by the exclusions and limitations of liability in the preceding paragraphs (1) to (4).

7.6 Our Platform bears no responsibility whatsoever for any arrangements made with third parties, including Travel Providers, as a result of using the our Services and/or our Platforms. If you encounter any issues with a booking made through the Platform(experievities.gr), you understand that it is your responsibility to resolve the matter directly with the relevant Travel Provider. Your sole recourse in such situations, including any refunds, lies with the Travel Provider and not with experievities.gr. When our Services and/or Platforms (experievities.gr) contain links to other websites or resources provided by third parties, these links are provided for informational purposes only. We have no control over the content of those sites or resources and assume no responsibility for them or any losses or damages that may arise from their use.

7.7 Advertising material from third parties may be displayed on our Services and/or Platforms (experievities.gr). Each advertiser is solely responsible for the content of their advertising material, and we accepts no liability for any errors, omissions, or inaccuracies therein.

7.8 To the fullest extent permitted by law, we (along with our officers, directors, employees, representatives, affiliates, providers, and third parties) do not accept liability for (a) any inaccuracies or omissions in the content displayed on or via the experievities.gr Services and/or experievities.gr Platforms, or (b) any special, exemplary, punitive, indirect, incidental, or consequential loss or damage of any kind (including lost profits or savings), whether based on contract, tort (including negligence), strict liability, or otherwise, incurred by you in connection with your access to, use of, or inability to access or use the experievities.gr Services and/or experievities.gr Platforms or any content provided therein.

8. Your liability to us

8.1 You are solely responsible and accountable to us for any consequences, including legal fees, arising from your use of the experievities.gr Platforms and/or its Services or any violation of these Terms. This includes actions, claims, proceedings, costs, damages, losses, and expenses incurred by us or our affiliated individuals such as officers, directors, employees, and agents.

9. Applicable Law

9.1 The law of the Federal Republic of Germany applies. In relation to a consumer, this choice of law only applies to the extent that it does not restrict any mandatory legal provisions of the state in which the consumer has their habitual residence.
